Why the answer changes at the state line

Consumer protection in towing is thin and uneven. Per U.S. PIRG: more than 30 states do not require towing rates to be displayed or disclosed; only 18 states require a free or reduced drop fee when you reach your car before it leaves; and only 20 states let you retrieve personal property regardless of whether you have paid.

This is one of the sharpest state-to-state differences in towing law, and it is also one of the least known, which is why lots are rarely challenged on it.

Items that are often treated separately

Several states carve out categories that must be released regardless of the general rule — commonly prescription medication, identity and immigration documents, tools required for work, and child safety seats. If you need something in one of those categories, say specifically what it is rather than asking generally for access to the vehicle.

How to ask so it is hard to refuse

Ask in writing, name the item, and ask the lot to state the authority for any refusal. An operator declining access in a state that requires it is creating exactly the written record a licensing agency acts on. Where the state does permit a hold, knowing that in advance saves a wasted trip.

What counts as personal property

The distinction that matters is between property and equipment. Loose items — documents, medication, a laptop, a child seat, tools — are generally personal property. Anything bolted or wired in, including an aftermarket stereo or a permanently mounted toolbox, is usually treated as part of the vehicle and stays with it. Readers most often get refused when they ask for something in the second category while believing it is in the first.

How access usually works in practice

Where retrieval is permitted, it is normally supervised and during business hours, not open access to the vehicle. Expect to be escorted, to be asked for identification, and to be limited to items you can identify before the vehicle is opened. Naming the specific item in advance both speeds this up and makes a refusal harder, because a lot declining a named prescription or a named child seat is refusing something concrete rather than a vague request to rummage.

Child seats and medication are often carved out

If you need one of these, say exactly that rather than asking generally for access to the car, and ask the lot to state the authority for any refusal — that request alone resolves a great many of these at the counter.
